1. About these Terms
Tradie (tradie.in and the Tradie apps) is run by [to be added before launch], a company registered in India (CIN [to be added before launch]), with its registered office at [to be added before launch] ("Tradie", "we", "us").
These Terms are an agreement between you and Tradie. By creating an account or using Tradie you accept them. If you do not accept them, please do not use Tradie. Our Privacy Policy explains how we handle your personal data and forms part of these Terms.
2. Who can use Tradie
- You must be at least 18 years old. Tradie does not allow accounts for anyone younger, and no work may be offered to or done by anyone under 18.
- You register with your own mobile number and confirm it with a one-time code. Keep your phone and codes private; you are responsible for activity on your account.
- The information you give (name, skills, experience, business details, ID) must be true and kept up to date.
- One person may have one account. The same account can be used as a worker, a business and a customer.
3. What Tradie does
Tradie is an online marketplace. It helps workers and service professionals ("workers" or "pros") find paid work, and helps businesses and households ("customers") find and pay them. Tradie runs the platform, collects and holds payments, and handles complaints.
Unless a booking clearly says otherwise, workers are independent and are not employees or agents of Tradie. Tradie does not direct or supervise how the work is done. The customer and the worker are responsible for the work agreed between them, and businesses remain responsible for their sites and for their duties to the people working there.
4. Prices and fees
- Every job shows its price before anyone agrees: the pay for workers, or the visit charge or job price for customers.
- Tradie charges workers a fee of 12% of the pay for each completed job. The fee and the worker's take-home amount are shown on every offer before it is accepted. There is no joining fee and no monthly charge.
- For businesses, the posted pay is the full cost per worker; Tradie's fee comes out of it. For households, Tradie's fee is taken from the pro's side and is not added to the price shown.
- Payment processing by PayU is included in Tradie's fee. Taxes such as GST are applied where the law requires and are shown before payment.
5. Advance payment and release of payment
To protect both sides, customers pay in advance and workers are paid when the work is confirmed.
- Payment in advance. When a booking is confirmed, the customer pays the full price shown through PayU. Tradie holds this money and does not release it to the worker until the steps below are complete. For shifts and crews, the business funds the booking in advance (for the whole booking or for each period shown at booking).
- Doing the job. The worker checks in when they arrive and checks out when they finish, and marks the job complete. Check-in and check-out times, location during the job, photos and in-app messages form the job record.
- Confirming and rating. The customer then has 24 hours to confirm the job and give a rating from 1 to 5 stars.
- A rating of 4 or 5 stars releases the payment to the worker straight away.
- A rating below 4 stars must come with a reason, and photos may be added. It does not cancel the payment. It starts a review: the worker is told the reason and can reply, our team checks the job record, and we decide within 48 hours.
- If the customer does not respond within 24 hours, the job is treated as completed and the payment is released.
- Outcome of a review. If the work was done as booked, the worker is paid in full, whatever the rating. If part of the work was not done, only that part is refunded to the customer and the rest is paid to the worker, or, where both agree, the worker may return to finish it. A full refund is given only when the job was not done at all.
- Shifts and crews. Pay for each day is released on the business's confirmation of attendance, or automatically 24 hours after the shift ends if the business does not raise an attendance problem in that time. Attendance problems are reviewed in the same way.
- Paying the worker. Released money reaches the worker's bank account or UPI ID within 24 hours, unless a bank, PayU or a legal requirement causes a delay.
- Release is final. Once a payment has been released to a worker, a later rating or complaint cannot take it back from them. A customer can still report a problem, and we will deal with it under section 6 and section 8.
- Misuse. A rating or complaint used only to avoid paying for work that was done is misuse. If 3 or more of a customer's complaints in 90 days are not upheld, that customer's later payments are released to workers straight away and reviewed afterwards, and repeated misuse can lead to the account being suspended or closed.
Tradie does not pay interest on money held, and holding a payment does not make Tradie a party to the work.
6. Cancellations and refunds
- Cancel before the worker sets off: full refund.
- Cancel after the worker has set off or arrived: the visit charge shown at booking is paid to the worker and the rest is refunded.
- Job not done: full refund after review. Part of the job not done: that part is refunded after review.
- If a worker cancels or does not arrive, the customer gets a full refund, and Tradie may offer the job to another worker.
- Refunds go back to the method used to pay, through PayU. The time the money takes to appear depends on your bank or payment provider.
7. Ratings
- Only the customer and the worker on a real booking can rate each other, and only once per booking.
- Ratings must be honest and about the work. Ratings or comments that are abusive, threatening, discriminatory, or meant to pressure the other side may be removed.
- A rating below 4 stars needs a reason, as described in section 5.
- No one may offer or demand money, favours or a discount in exchange for a rating.
8. Rules for everyone
- Treat everyone with respect. Harassment, threats, violence, and discrimination based on caste, religion, gender, disability or any other ground are not allowed.
- Do not ask for or make payments outside Tradie for work found through Tradie. Payments outside Tradie are not protected by section 5.
- Do not post false jobs, false profiles or illegal work, and do not use Tradie to recruit for work that is unsafe or unlawful.
- Anyone who works inside homes or cares for family members must complete ID verification. Do not share another person's ID or account.
- Do not copy, scrape, overload or interfere with Tradie, or try to get around its safety features.
9. If you work through Tradie
- List only skills you have and experience you can show. Do the work you accepted, safely, at the agreed time.
- Use the safety equipment the work needs, and stop and report it if a site or task is unsafe. You may refuse unsafe work without any penalty from Tradie.
- Check in and check out truthfully. False check-ins are misuse and can close the account.
- You are responsible for your own taxes on what you earn, except where the law requires Tradie to deduct or report tax.
10. If you hire through Tradie
- Businesses must give true business details and may be asked to complete business verification before posting work.
- The pay you post must not be below the minimum wage that applies to the work and the place. You must follow the labour, safety and other laws that apply to your site and your work.
- Provide a safe place of work and any safety equipment the law or the task requires.
- Households must give an accurate description of the job and safe access to the place of work.
11. Tradie Skills
Tradie Skills offers short courses inside Tradie. A certificate shows that you completed a Tradie Skills course. It is not a government licence or a qualification unless the course clearly says so. Some work, such as electrical work, may also need a licence under the law; you are responsible for holding any licence your work needs.
12. Suspending or closing accounts
You can close your account at any time from your account settings or by writing to us. We may suspend or close an account, or remove content, if it breaks these Terms or the law, or puts others at risk. Where it is safe to do so, we tell you the reason and give you a chance to respond. Money owed to a worker for work already done is still paid under section 5.
13. Liability
Tradie works to keep the platform available and safe, but cannot promise it will always be free of errors or interruptions. As far as the law allows, Tradie is not responsible for the quality of the work, or for loss or damage caused by a worker, customer or business, and Tradie's total liability to you for any claim is limited to the fees Tradie earned from the booking concerned. Nothing in these Terms limits any liability or right that cannot be limited under Indian law, including your rights under the Consumer Protection Act, 2019.
14. Disputes and governing law
Please contact us first; most problems can be solved quickly. These Terms are governed by the laws of India. Subject to your rights under consumer protection law, the courts at [to be added before launch] have jurisdiction.
